Terms and Conditions

1. Images from the Early American Digital Library (and its affiliate the Keigwin and Mathews Collection) are for one time or single-purpose use as specified prior to delivery of the image.

2. CUSTOMER'S USE OF THE EARLY AMERICAN DIGITAL LIBRARY'S ONLINE SYSTEM CONSTITUTES CUSTOMER'S ACCEPTANCE OF THE FOLLOWING TERMS AND CONDITIONS:

a) The images provided to the Customer by the Digital Library may not be used for any purpose other than that expressed solely by the Customer prior to delivery of the image. Customer does not acquire any rights in or to any image except as specified above.

b) Customer may only use a single copy of the digital images on a single computer. Customer may download the digital images onto only one computer hard drive or other computer medium, but may not otherwise make, use or distribute copies of the digital images for any purpose without the express permission of The Early American Digital Library. Customer may not use the digital images on an internal or external network of computers.

c) The Digital Library grants no rights until full payment is received. The Digital Library reserves all rights to the images, which shall remain the property of The Digital Library.

d) Customer will include the following copyright notice adjacent to each image: Copyright, The Early American Digital Library.

3. UNAUTHORIZED USE OF THESE IMAGES CONSTITUTES COPYRIGHT INFRINGEMENT AND SHALL ENTITLE THE EARLY AMERICAN DIGITAL LIBRARY TO EXERCISE ALL RIGHTS AND REMEDIES UNDER APPLICABLE COPYRIGHT LAW, INCLUDING AN INJUNCTION PREVENTING FURTHER USE AND MONETARY DAMAGES.
